Since the early 1990s, refugee crises in the Balkans, Central Africa, the Middle East, and West Africa have led to the international spread of civil war. In Central Africa alone, more than three million people have died in wars fueled, at least in part, by internationally supported refugee populations. To understand the role of refugees in the spread of conflict, Sarah Kenyon Lischer systematically compares violent and nonviolent crises involving Afghan, Bosnian, and Rwandan refugees. Lischer instead focuses on the often-ignored political context of the refugee crisis. Ziel der Arbeit ist es, am Beispiel des Internet-Glücksspiels einen Beitrag zur systematischen Fortentwicklung des Deutschen Glücksspielrechts zu leisten.Das Deutsche Glücksspielrecht ist eine komplizierte, historisch gewachsene Querschnittsmaterie, die in weiten Bereichen durch landesrechtliche Regelungen geprägt ist. Aufgrund der sozialschädlichen Wirkungen, die dem Glücksspiel zugeschrieben werden, handelt es sich um eine stark reglementierte Rechtsmaterie. Für viele Glücksspielarten bestehen daher staatliche Veranstaltungsmonopole, deren Verfassungsmäßigkeit jedoch angesichts der Berufsfreiheit privater Anbieter zunehmend angezweifelt wird. Diese Problematik erhält durch die Möglichkeit, Glücksspiele mittels Internet ohne großen Aufwand über Ländergrenzen hinweg anzubieten, eine neue Dimension. Hierbei taucht insbesondere die Frage nach der anwendbaren Rechtsordnung auf. Vor diesem Hintergrund wird unter anderem untersucht, wie die Reichweite der Wirkung einer nationalen Erlaubnis im Verhältnis zu anderen Staaten festzulegen ist und ob hierbei Besonderheiten für die Veranstaltung von Glücksspielen via Internet gelten. Aus strafrechtlicher Sicht wird der Frage nachgegangen, wann bei einer Veranstaltung von Glücksspielen im Internet eine Strafbarkeit gemäß den deutschen Vorschriften in Betracht kommt. Auf die in der Praxis wichtige Frage der Wettbewerbswidrigkeit von Internet-Glücksspielen wird ebenso eingegangen wie auf den Sonderfall der gewerblichen Spielvermittlung über das Internet.Angesichts eines staatlichen Veranstalterverhaltens, welches vor allem von fiskalischen Interessen geprägt ist, geht der Verfasser davon aus, dass im Glücksspielrecht mittelfristig ein Paradigmenwechsel "weg vom Ordnungsrecht, hin zum Wirtschaftsrecht" vollzogen wird. Es wird unter Berücksichtigung der Rechtsprechung des Europäischen Gerichtshofs die Prognose gewagt, dass das Zeitalter eines europäischen Glücksspielbinnenmarktes anbrechen wird.

Nach Ernst Blochs Prinzip Hoffnung und Hans Jonas' Prinzip Verantwortung ist im Übergang vom zweiten zum dritten Jahrtausend ein drittes Prinzip ins Zentrum der philosophischen Debatte gerückt: jenes der Menschenwürde. In Wirklichkeit handelt es sich eher um eine Wiederentdeckung als um etwas wirklich Neues, denn schon in der Nachkriegszeit spielte das Thema eine große Rolle. Heute jedoch erleben wir zweifellos ein noch größeres Revival. Diese Arbeit zeigt kurz den philosophischen Weg auf, der zur Herausbildung der Idee der Menschenwürde führte. Sodann wird versucht, deren wichtigste Rezeptionen im juristischen Bereich darzustellen; dabei werden einige exemplarische Rechtsdokumente in ihren Kernaussagen analysiert. Schließlich soll die Entwicklung der rechtsphilosophischen Debatte bis hin zu den vom medizinisch-biologischen Fortschritt angestoßenen Diskussionen erörtert werden. Eine Darstellung der Menschenwürde in der Schweizer Bundesverfassung findet sich im Anhang der Arbeit.Following Ernst Bloch's principle of hope and Hans Jonas's principle of responsibility, a third principle has, in the transition to the third millennium, moved to the centre of philosophical debate: that of human dignity. This study traces the emergence of the concept and attempts to illustrate the most significant aspects of its reception in the field of law. In addition, the work also discusses the course of legal-philosophical debates up to and including those elicited by bio-medical developments.

Für die Menschen im antiken Mittelmeerraum und darüber hinaus war die Stadt Rom jahrhundertelang ein Symbol der Macht gewesen, und zu Beginn des V Jahrhunderts n. Chr. war die Ewige Stadt nicht mehr von einer feindlichen Macht eingenommen worden, seit es die Gallier vor etwa 800 Jahren getan hatten - eine unerhörte Zeit der Ruhe in einer Welt, die von fast ständigen Kriegen geplagt war.
Als die Westgoten, die von den Römern als unkultiviert und minderwertig angesehen wurden, im Jahr 410 die Stadt Rom einnahmen und plünderten, war die Welt fassungslos. Dies veranlasste die Theologen des neu christianisierten Reiches, Gottes Plan auf Erden in Frage zu stellen, und ermutigte viele führende Römer, ihre Zukunft im Osten in Konstantinopel zu suchen. Tatsächlich brach das Weströmische Reich im späten V Jahrhundert, weniger als 70 Jahre nach der Plünderung Roms durch die Westgoten, vollständig zusammen, und die Frage, wie es von einer Supermacht zu einem schlecht geführten, schwachen und verletzlichen Schatten seiner selbst wurde, hat die Historiker über Jahrhunderte beschäftigt.
Bis heute lässt sich nur schwer nachvollziehen, wann der Niedergang begann, aber man kann sagen, dass die Plünderung Roms das Ergebnis einer Reihe von Faktoren war, die schon seit vielen Jahren zusammenwirkten. Nur die römische Arroganz hielt das Reich davon ab, die ernste Gefahr zu erkennen, in der sich seine Hauptstadt befand, und trug so zu den Ereignissen bei, die zum Fall Roms selbst führten. Der lateinische Ausdruck imperium sine fine ("Reich ohne Ende") brachte nicht nur die geografische Ausdehnung des mächtigen Imperiums auf den Punkt, sondern auch das Gefühl, dass es nie enden würde. Doch kaum mehr als 300 Jahre nach dem Ende der Pax Romana hatte das Weströmische Reich so gut wie aufgehört zu existieren. Im gleichen Zeitraum schrumpfte die Bevölkerung der Stadt Rom selbst von über einer Million Menschen auf weniger als 30.000. Innerhalb der Mauern Roms wurden weite Flächen wieder zu Weideland und Hirten weideten ihre Herden in einer surrealen Landschaft, in der sich die Ruinen von Bauwerken, die die Macht des Imperiums repräsentierten, wie das Patheon, das Kolosseum und das Marcellustheater, über eine karge Landschaft aus Gestrüpp und Wald erhoben.
