Lösen lässt sich das Dilemma nur, wenn man die Begrenzung des Diebstahlsbegriffs in Rom ernst nimmt.Custodia: At first glance, the sources on liability for custodia in Roman law are characterised by a fundamental inconsistency: on the one hand, the liability of a guardian appears as an automatic consequence of a theft of the thing left to him, on the other hand, as a consequence of a breach of due care. This discrepancy has triggered a pendulum movement in modern research. At one time custodia has been declared a guarantee liability, at another a form of liability for fault. The dilemma can only be solved if one seriously considers the limitation of the concept of theft in Rome.

Der Rechtsbruchtatbestand (§ 4 Nr. 11 i. V. m. § 3 Abs. 1 UWG) spielt im UWG eine zentrale Rolle. Bisweilen erscheint der Rechtsbruchtatbestand als ein "Meta-Recht", das in alle Bereiche des Rechts hineinragt. Ungeachtet dessen sind die dogmatischen Grundlagen des Rechtsbruchtatbestands weiterhin ungeklärt.Sarah Frey-Gruber kommt zu dem Ergebnis, dass der Rechtsbruchtatbestand eine spezialgesetzliche Ausprägung von § 823 Abs. 2 BGB bzw. des allgemeinen quasinegatorischen Unterlassungsanspruchs darstellt. Auf dieser dogmatischen Basis lassen sich die zahlreichen Auslegungsfragen, die die wettbewerbsrechtliche Praxis immer wieder beschäftigen, sachgerecht lösen. Zugleich wirft diese dogmatische Einordnung die bislang kaum gestellte Frage auf, warum es des Rechtsbruchtatbestands überhaupt bedarf. Aus materiellrechtlicher Sicht ist der spezifisch wettbewerbsrechtliche Rechtsbruchtatbestand überflüssig. Auch die weitreichende Regelung der Aktivlegitimation, die insbesondere zu einer Klagebefugnis von Verbänden und Kammern führt, vermag den Rechtsbruchtatbestand nicht zu rechtfertigen. Letztlich findet der deutsche Rechtsbruchtatbestand auch in den meisten europäischen Rechtsordnungen keine Entsprechung. Im Ergebnis schlägt die Autorin eine Streichung des Rechtsbruchtatbestands vor. Sie leistet damit einen Beitrag zur Bekämpfung der im Wettbewerbsrecht anzutreffenden Überregulierung und zu einer Angleichung der europäischen Wettbewerbsrechtordnungen.
