Trotzdem gibt es noch Missstände, die gegen die Verfassungsgerichtsbarkeit bzw. gegen den Vorrang der Verfassung wirken.Reformziele benötigen ein Vorbild und deshalb fällt die Wahl auf das deutsche System, welches die Rückkehr Deutschlands aus der Diktatur in die Demokratie sicherte. Dieses System kann inhaltlich für die arabische Welt in manchen Aspekten nützlich sein.Omar I. Houri untersucht die Systeme in einigen ausgewählten arabischen Ländern unter verschiedenen Aspekten und vergleicht sie mit dem System in Deutschland, um festzustellen, ob die Möglichkeit einer Reform existiert. Nach der Analyse der Verfassungsgerichtsbarkeiten in Ägypten, im Libanon und in Syrien lässt sich feststellen, dass die politische Führung in den drei Ländern die Justiz als eine dritte Gewalt und als einen Partner in der Staatsstruktur nicht anerkennt. Die Praxis hat gezeigt, dass in manchen Fällen die Justiz wie eine Behörde eines Ministeriums behandelt wird.
