Das Mittel hierzu ist ein Besitzvertrag, mit dem sich der Prekarist dem Geber unterwirft und sich auf eine Stufe mit Besitzern stellt, die eine Sache gewaltsam oder heimlich erlangt haben. Dieses besondere Institut prägt die Diskrepanz zwischen seinem vertraglichen Begründungsmodus und seinem Effekt, der in der Tatsache fehlerhaften Besitzes besteht. Sie führt zu einer schwankenden Einordnung des $aprecarium$z in der römischen Jurisprudenz und ist letztlich auch für die Abschaffung des Instituts verantwortlich, das sich nicht zum Begriff des Besitzes als tatsächlicher Sachherrschaft fügt.

Gegenstand der Arbeit ist das Recht der privilegierten Handelscompagnien, die als erste Gesellschaftsform über ein in Aktien zerlegtes Kapital verfügten.Im Anschluss an einen kurzen Abriss über die historische Entwicklung der Handelscompagnien bis ins 17. Jahrhundert zeichnet die Autorin die Rechtsverhältnisse der Handelscompagnien in Brandenburg/Preußen im 17. und 18. Jahrhundert nach. Dabei stellen die den einzelnen Gesellschaften erteilten Privilegien in Ermangelung allgemeiner Gesetze die maßgebliche Quelle dar. Anhand dieser Quellen wird im ersten Kapitel die Gründung der Gesellschaften, ihre innere Verfassung und Organisationsstruktur untersucht. Behandelt werden vor allem das Kapital der Gesellschaften, die Einteilung desselben in Aktien und die Frage der Rechtsfähigkeit der Gesellschaften.Trotz der wirtschaftlichen Erfolglosigkeit der meisten untersuchten Gesellschaften bildete sich mit der Aktie ein neues rechtliches Instrument heraus, das die rechtliche Grundlage für die heutige Aktiengesellschaft wurde. In zwei weiteren Kapiteln widmet sich die Verfasserin der Frage, wie die Rechtswissenschaft und der Gesetzgeber auf das Phänomen der Aktie und der in der privilegierten Handelscompagnie verkörperten Rechtsform reagierten. Es wird festgestellt, dass die privilegierten Handelscompagnien allgemein nur als Sonderform der societas des gemeinen Rechts verstanden und nicht als strukturell neue Erscheinung angesehen wurde. Als Besonderheit der Gesellschaften werteten die Zeitgenossen deren Privileg und nicht die Aufteilung des Kapitals in Aktien.
