Diese Kritik auf ihre Berechtigung zu überprüfen, ist das zentrale Anliegen der Autorin.Nach einer einführenden Darlegung des aktuellen Standes der jugendstrafrechtlichen Forschung und Judikatur zur Diversion beschreibt Ingke Goeckenjan den Ablauf des Berliner Diversionsverfahrens unter spezieller Berücksichtigung der einzelnen beteiligten Institutionen (Polizei, Diversionsmittler, Staatsanwaltschaft). In dem kleinen Buch wird die Konstitution einer Person behandelt, und zwar Person als Institution einer normativ strukturierten Gesellschaft und nicht als Ergebnis der Entwicklung eines Individuums. Diese These wird von Anfang an noch schärfer formuliert als in den Vorauflagen, und wer dort die Anerkennung der Leistungen von Individuen (Diskurs, Konsens) oder von ihren Auszeichnungen (Menschenwürde) vermisst hat, wird nunmehr noch stärker enttäuscht werden. Hinzugefügt wurde der Abschnitt über Person und Zwang (und zwar bewusst als eigener Abschnitt und an zentraler Stelle), teilweise neu gefasst derjenige zur Strafe. Die Ausführungen zur Zurechnung wurden erweitert, insbesondere durch neue Beispielsgruppen. Stärker als in den Vorauflagen wird immer wieder, insbesondere in dem Abschnitt zur Reaktion auf Störungen, herausgestrichen, dass alle normativen Institutionen - von einer einzelnen Norm über eine Person oder ein Gericht bis hin zu einem Normensystem - nur dann im Alltag Orientierung bieten können, wenn sie kognitiv untermauert sind.
