Im Hinblick auf die rechtssoziologische Vertragstheorie überprüft sie überdies das in den USA von Macneil (relational contracts) und Macaulay (non-contractual relations) bei der empirischen Untersuchung von langfristigen Verträgen zwischen Wirtschaftsunternehmen gefundene Ergebnis, wonach weder das gesetzliche noch das vertraglich vereinbarte Recht bei der Durchführung solcher Verträge tatsächlich beachtet werden. Unter beiden Aspekten leistet Matthias Horz einen wertvollen Beitrag zur Vertragssoziologie. Schließlich stellt der Verfasser auf Grund seiner Erkenntnisse Überlegungen zur Änderung des Urheberrechts oder des Verlagsgesetzes an und macht Vorschläge für die Praxis der Vertragsgestaltung.

Die Behandlungsfehlerhaftung steht dabei im Mittelpunkt der Betrachtung. Die Schwierigkeiten, die mit der Anwendung des § 280 Abs. 1 BGB auf die nicht erfolgsbezogene Dienstleistungshaftung und hier speziell auf die Arzthaftung bestehen, werden eingehend erörtert. Ein besonderer Fokus ist dabei auf die Regelung des § 280 Abs. 1 S. 2. BGB gerichtet. Am Ende der Betrachtung steht ein Vorschlag zu einer neuen Beweislastverteilung im Arzthaftungsrecht, der vor allem dem Gebot des fairen Verfahrens Rechnung trägt und die der alten Rechtslage anhaftende Rechtsunsicherheit beseitigt.
