Ausgangspunkt der Überlegungen ist die Bestimmung des Unrechts der Erpressung. Dieses wird darin gesehen, daß der Erpresser für sein Opfer einen Grund schafft, so zu handeln, wie der Erpresser es will. Dementsprechend schützt der Erpressungstatbestand nicht nur die äußere Betätigungsfreiheit sondern auch die Freiheit, einen Entschluß zu fassen. Für den erpresserischen Angriff bedeutet dies, daß der Angriff auf das Vermögen gerade durch den Angriff auf die Willensbildungsfreiheit erfolgt und damit beide untrennbar miteinander verbunden sind. Unter Würdigung der Historie der §§ 240, 253 StGB sowie konkreter Aspekte der Rechtsordnung wird ferner festgestellt, daß das Erlaubtsein der Ausführung die Ankündigung eines Verhaltens nicht per se zu einer angriffsuntauglichen Drohung macht.Die Untersuchung der einzelnen Notwehrvoraussetzungen unter Berücksichtigung dieser Ergebnisse zeigt, daß die Drohung mit einem erlaubten Verhalten einen gegenwärtigen rechtswidrigen Angriff darstellt. Um diesen rechtswidrigen Dauerzustand des Entscheidungsnotstandes zu beseitigen, ist es auch erforderlich und geboten, in die Rechtsgüter des Erpressers, unter Umständen bis hin zum Rechtsgut Leben, einzugreifen, da es der Erpresser ist, der für diesen Zustand verantwortlich ist und ihn jederzeit durch Rücknahme der Drohung beseitigen kann.
