Im Mittelpunkt der hier vorgelegten Untersuchung stehen drei Grundfragen aus dem Bereich der Anstiftung, die seit Jahrzehnten die Strafrechtswissenschaft beschäftigen: die Frage nach dem Strafgrund der Anstiftung, nach der Strafbarkeit des "agent provocateur" und das Problem der Auswirkung der Objektsverwechslung des Täters auf den Anstifter.Durch die Auseinandersetzung mit alten und neuen Theorien arbeitet der Verfasser zunächst die dogmatischen Grundlagen heraus, die eine Strafbarkeit des Anstifters begründen, und zeigt, daß diese Streitfrage eng mit der Frage nach den Gründen der Strafbarkeit überhaupt zusammenhängt. Anschließend widmet er sich der Frage nach der Strafbarkeit desjenigen Anstifters, der einen anderen zu einer Straftat veranlaßt, ohne jedoch die Vollendung oder die materielle Beendigung der Haupttat zu wollen. Er macht deutlich, daß sich die gebotene strafrechtliche Behandlung des Provokateurs in den meisten Fällen von dem fehlenden oder vorhandenen Rechtsgutsverletzungswillen des Provokateurs ergibt. Fehlgriffe des Gesetzgebers verhindern jedoch eine konsequente Durchsetzung der Rechtsgutsverletzungslösung. Bei den abstrakten Gefährdungsdelikten hängt die strafrechtliche Behandlung des "agent provocateur" auch mit den allgemeinen Problemen zusammen, die diese Deliktsart aufweist, und stellt nicht ein rein teilnahmespezifisches Problem dar.Wird der Täter von einer anderen Person zur Begehung einer Straftat bestimmt und unterläuft ihm bei der Ausführung der Tat ein "error in persona", erhebt sich die Frage, wie sich die Objektsverwechslung des Täters auf die strafrechtliche Behandlung des Anstifters auswirkt, ob also die Existenz des doppelten Anstiftervorsatzes in einem solchen Fall zweifelhaft ist. Hier zeigt Marios Nikolidakis, daß die Lösung dieser Fälle nicht immer aus der Alternative "entweder ein error in persona oder eine aberratio ictus des Anstifters" abzuleiten ist. Die Unbeachtlichkeit des Täterirrtums für den Anstifter ergibt sich aus der fehlenden unmittelbaren Identifizierung des Opfers seitens des Anstifters.

Exemplarisch zeigt er u. a. die durch die Grundrechte gesetzten Grenzen von Lizenzauflagen oder der Zentralvermarktung auf. Besondere Beachtung wird ferner dem Einfluss der Rechtsform der Sportvereine zuteil, insbesondere in Bezug auf das wirtschaftliche Handeln von Idealvereinen. Dabei zeigt der Autor auf, daß weder unter dem Gesichtspunkt der Menschenwürde noch unter Berücksichtigung des Sozialstaatsprinzips ein Anspruch des Schuldners gegen den Staat auf Befreiung von seinen privatrechtlichen Verbindlichkeiten postuliert werden kann. Die bestehende gesetzliche Regelung der Restschuldbefreiung wird hingegen im Ergebnis als zulässige Inhalts- und Schrankenbestimmung des Eigentums qualifiziert. Gesondert betrachtet der Autor die Praxis der Verwalterauswahl nach offenen und geschlossenen Listen, wobei er die neuesten gesetzlichen Änderungen berücksichtigt und insgesamt eine kritische Bilanz zieht.

Gustav Glück, director of Vienna's Kunsthistorisches Museum, wrote as early as 1922 of Gustav Klimt (1862-1918) that his drawings were perhaps his ultimate artistic achievement. This founder of Secessionsstil and leader of the revolt against the Viennese academies was able to achieve greater freedom in his drawings than in his more laboriously executed paintings. While there are only about two hundred completed oils, the drawings number in the thousands, and are reported to have at times quite littered his studio. He himself considered them finished works, and often exhibited them alongside his paintings.

Klimt's subject matter is almost exclusively the female body, naked or half clothed. For this he earned the reputation of erotic artist, and while he did not suffer the outright persecutions of his successors Schiele and Kokoschka, he was nevertheless subjected to the trials that a frankly erotic artist had to undergo in Vienna, where the everyday subject of conversation was the current love affairs of celebrities but where audiences were shocked by the sight of a dancer's naked legs. An issue of Ver Sacrum which reproduced one of his drawings was confiscated by the authorities.
The drawings reveal above all that concern of great draughtsmen from Michelangelo through Blake the marriage of subtle grace and expressive dynamism that is the human body. Like that of these two past masters, Klimt's method is essentially linear. He knew, as they did, that line, rather than shading, the creation of volume or the use of color, is the natural medium for expressing the freedom of the living human form. As he matured as an artist there was an increasing awareness of this and a greater and greater spontaneity that approached, finally, "the lightness of a net of gauze."

Auftragsforschung muss unter diesem Aspekt nicht immer problematisch sein, wird dies aber mit Gefälligkeitsgutachten, wenn parteilich und intransparent betrieben. Bei Verfahren der Berufung auf eine Professur muss ein fairer Wettbewerb gewährleistet sein, was bei Pro-forma-Ausschreibungen nicht der Fall ist. Nicht illegal, aber hochschulpolitisch nicht wünschenswert ist die immer häufigere Erscheinung sog. Spagatprofessoren. Der Verbesserung der Lehre sollte ein größerer Stellenwert als bisher eingeräumt werden. Im Hinblick auf die Forschung plädiert die vorliegende Studie für die Beibehaltung der Habilitation; organisatorische Mängel im Verfahren müssen allerdings abgestellt werden. Ein Schwerpunkt der Erörterung des Themas Gute Wissenschaft betrifft die Praxis wissenschaftlicher Veröffentlichungen. Hierbei geht es nicht nur um Plagiate, sondern auch um die Beurteilung von Doppelveröffentlichungen, Veröffentlichungen im Kollektiv oder anonym, und um den Umfang von Veröffentlichungslisten wie überhaupt um den Stellenwert von Veröffentlichungen und den damit zusammenhängenden Veröffentlichungsdruck. Für gute Wissenschaft ist auch die Wissenschaft als Lebensform, insbesondere das Prinzip der Kollegialität, von nicht zu unterschätzender Bedeutung.Die vorliegende Studie stützt sich auf Vorarbeiten z.B. der DFG, der MPG und des deutschen Hochschulverbandes, vor allem aber auf die eigenen Erfahrungen des Verfassers aus seiner langjährigen Tätigkeit als Hochschullehrer an verschiedenen Universitäten des In- und Auslandes.
