Ohnehin erscheinen viele Fälle, die früher im Gnadenwege gelöst wurden, heute mit den Mitteln des Rechts bewältigbar: Teile des materiellen Strafrechts und des Strafvollzugsrechts können als in die Rechtsordnung diffundierte Gnadenaspekte verstanden werden. Nimmt man hinzu, dass nach der Rechtsprechung Gnadenentscheidungen nicht justiziabel sein sollen, stellt sich die Frage nach der Berechtigung von Gnade im Verfassungsstaat des Grundgesetzes erneut und verstärkt. Diesen Fragen widmet sich der Band unter Einbeziehung historischer und theologischer Analysen und unter Einbeziehung der Gnadenpraxis in Bund und Ländern.
