Welche Anforderungen stellt der allgemeine Gleichheitssatz aus Art. 3 Abs. 1 GG an die Vergabe öffentlicher Aufträge? Ausgehend von der Überlegung, dass in der Beauftragung eines Unternehmens eine rechtfertigungsbedürftige Ungleichbehandlung gegenüber seinen Konkurrenten liegt, untersucht Tobias Pollmann zunächst, welche Auswahlkriterien und Verfahrensgestaltungen gleichheitsgerecht sind. Dabei entwickelt er anhand einer Analyse vergaberechtlicher Einzelprobleme die These, dass der Wirtschaftlichkeitsgrundsatz des Haushaltsrechts als Quelle gleichheitskonformer Differenzierungskriterien eine überragende Rolle einnimmt. Mit Art. 3 Abs. 1 GG ist die Auswahlentscheidung zugunsten eines Auftragsinteressenten in erster Linie dann vereinbar, wenn sie im Einklang mit dem Wirtschaftlichkeitsgrundsatz steht. Das Zusammenspiel des Wirtschaftlichkeitsgrundsatzes und des allgemeinen Gleichheitssatzes führt dazu, dass die innenrechtlichen Bindungen der öffentlichen Verwaltung ins Außenverhältnis zu den privaten Auftragsinteressenten "extravertiert" werden. Dagegen sieht der Autor in der staatlichen Auftragsvergabe keinen Eingriff in das Grundrecht der Berufsfreiheit der leer ausgehenden Konkurrenten aus Art. 12 Abs. 1 GG.Im zweiten Teil beleuchtet Tobias Pollmann den Primär- und Sekundärrechtsschutz. Anders als das Bundesverfassungsgericht hält er die Rechtsschutzgarantie des Art. 19 Abs. 4 GG für einschlägig und leitet aus dieser Vorschrift einen weitergehenden Primärrechtsschutz ab, als ihn die Gerichte im öffentlichen Vergaberecht derzeit gewähren.

Das mit dem ÖPP-Beschleunigungsgesetz im Juni 2005 in das nationale Vergaberecht aufgenommene Verfahren des Wettbewerblichen Dialogs ist für die Vergabe besonders komplexer Aufträge zugeschnitten, bei denen sich die Erstellung der Leistungsbeschreibung häufig als schwierig erweist. Die herkömmlich streng formalisierten Verfahrensregelungen laufen dem bei derartigen Beschaffungsvorhaben bestehenden Bedürfnis des Auftraggebers nach einer flexiblen Verfahrensgestaltung zuwider. Dennoch ist im Interesse der Verfahrensteilnehmer ein transparenter, diskriminierungsfreier Verfahrensablauf zu gewährleisten.Unter Berücksichtigung von Genese und Zielsetzung der gemeinschaftsrechtlichen Vorgaben untersucht Tobias Helmut Schneider den Anwendungsbereich des Wettbewerblichen Dialogs und ordnet das neue Verfahren in das bestehende System der vergaberechtlichen Verfahrensarten ein. Für die Anwendungsvoraussetzungen "besonders komplexer Auftrag" und "objektive Unmöglichkeit" werden Beurteilungskriterien herausgearbeitet. Es folgt eine Untersuchung vergleichbarer Verfahrensabläufe zur Bewältigung besonders komplexer Beschaffungsvorhaben auf internationaler Ebene nach Maßgabe des Agreement of Government Procurement und der UNCITRAL Modellgesetze. Die den Hauptteil der Arbeit bildende Darstellung des Verfahrensablaufs des Wettbewerblichen Dialogs zeigt die dem öffentlichen Auftraggeber innerhalb des normierten Verfahrensrahmens zukommenden Gestaltungsspielräume auf und untersucht diese unter Heranziehung der Grundsätze des Vergaberechts auf ihre Grenzen. Dabei wird deutlich, dass dem Auftraggeber innerhalb der vorgegebenen Verfahrensregelungen genügend Freiraum eingeräumt ist, um das Verfahren entsprechend seinen Prioritäten bei der Lösungsfindung zu gestalten.
