Dabei gelangt er zu dem Ergebnis, dass die mit dem Alles-oder-Nichts-Prinzip verbundenen Probleme auf die Inflexibilität der Leistungsfreiheitstatbestände zurückzuführen sind, die Leistungsfreiheit als Sanktion nicht unbedingt erforderlich ist und im Zivilrecht allgemein eine Tendenz zum Abbau von Alles-oder-Nichts-Regelungen zu Gunsten flexibler Regelungen auszumachen ist. Auf Basis dieser Ergebnisse formuliert Philipp Neumann einen Vorschlag für eine Gesetzesänderung.

Ein kleinerer Teil der hinter der Kategorie verborgenen Aspekte hingegen ist als Bestandteil des (der Abwägung vorgelagerten) zwingenden Rechts zu qualifizieren. Des Weiteren entlarvt Müller auch die Figur der "privatnützigen" Planfeststellung als überflüssig. Ebenso kommt der Kategorie der verbindlichen Bedarfsfestlegungen in Ausbaugesetzen für die Planfeststellung nicht die Bedeutung zu, die ihr gemeinhin zuerkannt wird. Aus diesen Erkenntnissen folgt eine erhebliche Vereinfachung der dogmatischen Struktur des Fachplanungsrechts. Sie ermöglicht es dem Rechtsanwender, sich auf die zentralen materiellen Maßstäbe fachplanerischer Entscheidungen, insbesondere auf das Abwägungsgebot, zu konzentrieren. Der Autor liefert den Praxistest für das im Rahmen der Untersuchung entwickelte dogmatische Konzept anhand der Planfeststellung für Energieanlagen nach dem EnWG.
