Im Oktober 2001 führte der Europäische Gesetzgeber die erste europaweit verfügbare Gesellschaft, die Europäische Gesellschaft (SE) ein. Im Lichte der strengen Vorgaben zur SE, insbesondere im Hinblick auf die Ausgestaltung ihrer Unternehmensmitbestimmung, stellt sich die Frage nach der Vereinbarkeit paritätischer Mitbestimmung mit Europäischem Recht. Sie findet nach dem Willen des Europäischen Gesetzgebers nunmehr auch auf SE mit deutscher Beteiligung Anwendung. Durch ein komplexes Zusammenwirken von europäischen und deutschen Normen wird sie so zur Rückfallebene im Fall des Scheiterns einer Einigung von Arbeitnehmern und Arbeitgebern über Form und Umfang der Mitbestimmung in der "deutschen" SE. Der Niederlassungsvorgang fällt hierbei in den Anwendungsbereich der Europäischen Niederlassungsfreiheit, da er bei Gründung einer SE in allen Fällen die von Art. 43 EG statuierten Vorgaben erfüllt. Unter Beachtung der Rechtsprechung des EuGH zur Verhältnismäßigkeit einer freiheitsbeschränkenden Maßnahme muss die Rechtfertigung eines Eingriffs ausscheiden, da es den Regelungen des MitbestG sowohl an Geeignetheit als auch an der vom EuGH kombinierten Erforderlichkeit / Angemessenheit fehlt. Eine europarechtskonforme Auslegung der Vorschriften des MitbestG kommt nach den prohibitiven Aussagen des BVerfG im "Mitbestimmungsurteil" indessen nicht in Betracht, weshalb die relevanten Vorschriften des MitbestG europarechtswidrig sind. Sie sollten abgeschafft und durch ein einheitliches Mitbestimmungsgesetz auf Grundlage des DrittelbG ersetzt werden.

It also takes in the weapons themselves, how they were placed on ships, and how this reflected the tactical concepts of naval AA defense. Renowned military historian Norman Friedman offers striking insights he argues, for example, that the Royal Navy, so often criticized for lack of "air-mindedness," was actually the most alert to the threat, but that its systems were inadequate-not because they were too primitive but because they tried to achieve too much.
The book summarizes the experience of WW2, particularly in theaters where the aerial danger was greatest, and a concluding chapter looks at post-1945 developments that drew on wartime lessons. All important guns, directors and electronics are represented in close-up photos and drawings, and lengthy appendices detail their technical data. It is, simply, another superb contribution to naval technical history by its leading exponent.
