Eine gemeinwohlgerechte Aufgabenwahrnehmung wird sichergestellt, indem benannten Stellen materiell-rechtliche Anforderungen und Handlungsmaßstäbe vorgegeben werden und ihre Einhaltung anhand einer staatlichen Kontrolle der privaten Kontrolleure gewährleistet wird. Den normativen Rahmen für die private Aufgabenwahrnehmung benannter Stellen bildet ein zivilrechtlicher Werkvertrag mit den Herstellern von Medizinprodukten. Diesem entspringen sämtliche Befugnisse benannter Stellen. Grenzüberschreitende Sachverhalte lassen sich häufig nicht zufriedenstellend durch nationales Recht regeln. Als eine Alternative wird deswegen eine Selbstregulierung zunehmend globalisierter Gesellschaftsfelder diskutiert. Die dabei entstehenden privaten Normenordnungen sollen ein transnationales Recht bilden, welches gleichberechtigt neben das nationale und internationale Recht tritt und unabhängig von diesen gilt. Ziel dieser Arbeit ist es herauszufinden, inwieweit sich bereits derartige universelle private Normenordnungen gebildet haben und ob diese als transnationales Recht bezeichnet werden können.Nils Ipsen untersucht vor dem Hintergrund der rechtstheoretischen - insbesondere autopoietischen - Geltungsbegründungen drei Bereiche, in denen sich derartige Normenordnungen herausgebildet haben sollen: der internationale Handel mit der lex mercatoria, das Internet mit der lex informatica und der internationale Sport mit der lex sportiva. Der Autor kommt zu dem Ergebnis, dass nur die Normenordnungen praktische Bedeutung erlangen können, die von einer sozialmächtigen Institution unterstützt werden. Aber selbst diese werden auf vielfältige Weise vom staatlichen Recht beeinflusst, so dass das staatliche Recht den privaten Normenordnungen über- und nicht gleichgeordnet ist. Letztere können deswegen nur dauerhaft existieren, wenn sie sich an den Grundsätzen der Rechtsstaatlichkeit orientieren. Vor diesem Hintergrund überzeugen die rechtstheoretischen Begründungen eines eigenständigen transnationalen Rechts nicht, so dass die Frage nach dessen Existenz gegenwärtig zu verneinen ist.

This element explores the prospects of using probability theory to provide an inductive logic: a framework for representing evidential support. Constraints on the ideal evaluation of hypotheses suggest that the overall standing of a hypothesis is represented by its probability in light of the total evidence, and incremental support, or confirmation, indicated by the hypothesis having a higher probability conditional on some evidence than it does unconditionally. This proposal is shown to have the capacity to reconstruct many canons of the scientific method and inductive inference. Along the way, significant objections are discussed, such as the challenge of inductive scepticism, and the objection that the probabilistic approach makes evidential support arbitrary.
