In der vorliegenden Arbeit befasst sich Carola Reichold zunächst eingehend mit der Entstehungsgeschichte des § 406 BGB. Diese Vorschrift bestimmt die Voraussetzungen, unter denen der Schuldner einer abgetretenen Forderung eine ihm gegen den bisherigen Gläubiger zustehende Gegenforderung auch dem neuen Gläubiger gegenüber aufrechnen kann. Die Verfasserin zeigt unter Heranziehung der Gesetzgebungsmaterialien auf, dass ein Redaktionsversehen bei der Entwicklung des Wortlautes der Vorschrift entgegen einer Auffassung in der Literatur nicht festzustellen ist. Im Anschluss erläutert sie Begriffe und Aufbau des § 406 BGB und arbeitet im Einzelnen die verschiedenen Fallgruppen des zweiten Halbsatzes der Norm heraus.Der Schwerpunkt der Arbeit liegt auf der in Rechtsprechung und Literatur umstrittenen Frage, ob bei einer Vorauszession der Forderung die hierüber gegebene Kenntnis des Schuldners einer Kenntnis der Abtretung i. S. d. § 406 BGB gleichzustellen ist. Nach Darstellung des Diskussionsstandes beleuchtet Carola Reichold den Normzweck und die systematische Einordnung dieser Schuldnerschutzvorschrift. Sie arbeitet heraus, dass der Gedanke des Vertrauensschutzes für die vorliegende Fragestellung maßgebliche Bedeutung hat. Die Verfasserin kommt im Anschluss an die Rechtsprechung des BGH zu dem Ergebnis, dass die Kenntnis einer Vorausabtretung der Kenntnis der Abtretung i. S. d. § 406 BGB gleichsteht. Im abschließenden Kapitel zeigt sich die praktische Relevanz des Meinungsstreites bei der Frage, wie das Insolvenzrisiko des Zedenten zwischen Schuldner und Zessionar zu verteilen ist, wenn der Zedent, welcher seine Hauptforderung im Voraus abgetreten hat, in Insolvenz gerät.

Authority, Gender, and Midwifery in Early Modern Italy argues that new institutional spaces to care for pregnant women and educate midwives in Italy during the eighteenth century were not strictly medical developments but rather socio-political responses both to long standing concerns about honor, shame, and illegitimacy, and contemporary unease about population growth and productivity. In so doing, this book complicates our understanding of such sites, situating them within a longer genealogy of institutional spaces in Italy aimed at regulating sexual morality and protecting female honor.
It will be of interest to scholars of the history of medicine, religious history, social history, and Early Modern Italy.
